Domestic Reverse Charge for Mobile Phones and Electronics in UAE: VAT Filing and Penalties

Since 30 October 2023, VAT on most trade sales of phones, computers and tablets moves to the registered buyer. Here is who it covers, what paperwork protects the seller, how retail and re-exports differ, and the penalties when a deal is booked wrongly.

Under Cabinet Decision 91/2023, in force since 30 October 2023, a UAE supplier selling mobile phones, computers, tablets or their parts to a VAT-registered buyer who resells them does not charge VAT; the buyer accounts for the 5% on its own VAT 201 and recovers it on the same return. Retail sales to consumers stay at 5%. Getting the treatment wrong makes the return incorrect (AED 500 first time) plus the tax.

Does the domestic reverse charge apply to your phone or electronics business?

It applies when you sell or buy phones, computers, tablets or their parts within the UAE, the buyer is VAT registered and the devices are bought for resale. You must be registered for VAT yourself first, which is mandatory once taxable sales plus imports pass AED 375,000 in 12 months; device traders usually pass that within weeks.

Which devices and deals does Cabinet Decision 91/2023 cover?

The decision covers mobile phones, smartphones, computers, tablets and their parts when they are sold between businesses in the UAE for resale. It was introduced to stop fraud in which sellers collected VAT on high-value devices and disappeared before paying it to the FTA.

When the buyer accounts for the VAT

Three things must line up: the goods are covered devices, the buyer holds a valid TRN, and the buyer is purchasing to resell. When they do, your invoice carries no VAT, it states that the reverse charge applies, and the buyer declares 5% as output tax and claims it back as input tax in the same period.

When it does not apply

Sales to unregistered traders, to consumers and to businesses buying laptops or phones for their own staff stay at 5% charged by you. Accessories such as cases, chargers and earphones are not devices, so check each line of a mixed invoice before you drop the VAT.

What should a phone wholesaler collect from buyers, and why do shop sales stay at 5%?

Before invoicing without VAT, collect a written confirmation from the buyer that it is VAT registered and buying the devices for resale, and check its TRN. Without that file, the FTA can treat the sale as one on which you should have charged 5%.

Buyer declarations in practice

Wholesalers in the Deira and Naif markets deal with dozens of small resellers a week, many buying in cash. Keep a customer file with the trade licence, TRN certificate, the signed resale confirmation and a dated screenshot of the TRN check. Refresh it when a customer’s licence renews, because a cancelled TRN turns a clean reverse-charge sale into a 5% sale you never collected.

Retail sales to consumers

A shop selling a handset to a resident or visitor charges 5% as normal. An iPhone priced at AED 5,313 includes AED 253 of VAT (5,313 x 5/105). For consumer sales under AED 10,000 a simplified tax invoice is enough. Visitors may be able to claim VAT back through the Tax Refunds for Tourists scheme under that scheme’s own conditions, but the reverse charge never applies to a retail sale.

How do re-exports and reverse charge purchases appear on the VAT 201?

As a buyer, you enter reverse-charge device purchases in Box 3 with the 5% VAT, and recover the same VAT in Box 10. Exports go in Box 4 at zero, and retail sales in Box 1 at 5%.

Re-exporters buying locally still use the reverse charge when they give the supplier the resale confirmation, then zero-rate the export once they hold proof the goods left the UAE, such as the exit declaration and airway bill or bill of lading. Check GCC destinations before zero-rating. The export evidence rules are in VAT zero-rating rules for exports, and imports in VAT on imports through customs. As a seller, report reverse-charge sales as the FTA’s return guidance directs.

Documents an electronics trader needs for reverse charge VAT

Keep customer files, invoices and export papers for at least five years. The customer file is what protects a reverse-charge sale in an audit.

  • Customer file: trade licence, TRN certificate and signed resale confirmation
  • Dated TRN verification record for each trade customer
  • Sales invoices stating the reverse charge applies
  • Supplier invoices for reverse-charge purchases
  • POS reports and simplified tax invoices for retail sales
  • Export declarations, airway bills and bills of lading
  • Customs import declarations under your TRN
  • Stock records by IMEI or serial number where your system supports it

VAT deadlines for phone and electronics traders

The VAT 201 and payment are due by the 28th of the month after each tax period; the other dates below affect planning.

What penalties apply to reverse charge errors in 2026?

Cabinet Decision 129/2025 sets the VAT penalties for violations from 14 April 2026. In device trading the tax difference is the big number, because margins are thin and values are high.

How it builds: a wholesaler sells AED 400,000 of phones without VAT to a buyer whose TRN had been cancelled. The FTA can treat 5% as due from the seller, AED 20,000. If the error is found in an audit rather than disclosed, the voluntary disclosure rate after notification starts at 15% of the difference (AED 3,000) plus 1% a month. 6 reverse charge mistakes electronics traders make

Most reverse charge problems come from the speed of the trade: cash deals, WhatsApp orders and customers who change names and licences.

  • Charging VAT when the reverse charge applies. The buyer cannot recover VAT wrongly charged, disputes follow, and both returns are incorrect.
  • Not charging VAT when it should apply. Dropping VAT for an unregistered reseller or a company buying for its own use leaves you owing 5% you never collected.
  • No buyer declaration on file. Without the resale confirmation and TRN check, the sale cannot be defended.
  • Buyer forgets Box 3. Recovering nothing and declaring nothing seems harmless, but the return is still incorrect (AED 500 first time).
  • Accessories swept into the reverse charge. Cases and chargers on a phone invoice still need 5%.
  • Exports zero-rated without exit papers. Goods handed to a buyer’s driver without customs exit evidence are reassessed at 5%.

How can phone traders keep reverse charge VAT clean?

Build the check into the sale itself: no TRN and resale confirmation, no zero-VAT invoice.

  • Before a first trade sale: open a customer file with licence, TRN certificate and resale confirmation
  • On every no-VAT invoice: verify the TRN is active and state that the reverse charge applies
  • Weekly: review invoices with mixed devices and accessories
  • Per shipment: collect exit declarations for exports and customs declarations for imports
  • Monthly: reconcile reverse-charge purchases to Box 3 and Box 10 figures
  • Quarterly: file and pay the VAT 201 by the 28th
  • Annually: refresh customer files and remove resellers whose TRN was cancelled
  • When you find an error: correct it by voluntary disclosure before the FTA contacts you

An illustrative Deira wholesaler buys AED 2,000,000 of smartphones from a UAE distributor under the reverse charge, sells AED 1,400,000 to registered resellers under the reverse charge, sells AED 210,000 over its retail counter and re-exports AED 600,000 to buyers in Africa with exit papers. Figures are before VAT.

If AED 80,000 of the reseller sales went to a buyer with no valid TRN, the wholesaler would owe another AED 4,000 (5% x 80,000) out of its own margin. Filing and paying one month late for the first time costs AED 1,000 plus 14% a year on AED 6,500 for one month (AED 76), so AED 1,076.

Can a device trader handle reverse charge VAT without an accountant?

A shop selling mainly to consumers can often manage in-house. A wholesaler mixing reverse charge, retail and exports benefits from a quarterly review because one bad customer file can cost more than a year of fees.

Why do UAE electronics and smartphone wholesalers no longer charge VAT on bulk sales to other traders?

Since 30 October 2023, Cabinet Decision 91/2023 moves the VAT on business sales of phones, computers, tablets and their parts to the VAT-registered buyer who resells them. The seller invoices without VAT and the buyer declares and recovers the 5% on its own return, after confirming it is registered and buying for resale.

How does a phone trading company work out its VAT?

Charge 5% on sales that are not under the reverse charge, subtract recoverable input VAT, and file the VAT 201 by the 28th after each quarter. For reverse-charge purchases, declare the VAT in Box 3 and recover it in Box 10, so the net is usually zero.

I am buying an iPhone in Dubai and the price includes about AED 253 of VAT. Does that VAT come back to me?

Not from the shop. Consumer sales of phones are standard-rated at 5% because the reverse charge only covers sales to registered resellers. Visitors may be able to use the Tax Refunds for Tourists scheme, subject to its conditions.

Are phones bought in Dubai tax-free?

No. A retailer selling a phone to a consumer charges 5% VAT and can issue a simplified tax invoice for sales under AED 10,000. The domestic reverse charge never applies to retail sales.

What do I pay in VAT when bringing electronics into the UAE for resale?

Import VAT is 5%, with customs duty charged separately. Imports count toward the AED 375,000 registration threshold, and once registered with your TRN on the declaration you recover the import VAT through your return.

How do I export phones from the UAE, and do I charge VAT?

Exports can be zero-rated when you keep proof the goods left the UAE, such as the exit declaration and shipping documents. Confirm the treatment of sales into Saudi Arabia and other GCC states separately before zero-rating them.

Does the reverse charge apply to used mobile phones in the UAE?+

The decision is built around the type of device, the buyer’s registration and the purpose of resale. If you trade used handsets with other dealers, confirm the treatment of those deals before dropping VAT from the invoice. Second-hand traders should also read about the profit margin scheme, which works differently.

What happens if a buyer gives a false resale declaration?+

Keep the signed declaration and TRN check as evidence that you acted in good faith. If the buyer was not entitled to the reverse charge, the FTA can look at who should have accounted for the VAT, so a complete customer file is your best protection.

Do electronics retailers in Dubai need to change anything because of the reverse charge?+

Their consumer sales stay at 5%. The change hits their purchases: when they buy stock from a distributor for resale, they give a resale confirmation and account for the VAT in Box 3 and Box 10 instead of paying it to the supplier.

Is VAT on laptops bought for office use reverse charged?+

No. A company buying computers for its own staff is not reselling them, so the supplier charges 5% and the buyer recovers it as normal input VAT if it is used for taxable business.

How often do mobile phone traders file VAT returns?+
