Do Fujairah Creative City freelancers and companies have to file Corporate Tax?

Companies always do; freelancers on a personal permit only above AED 1M of business turnover in a calendar year. That split matters more in Fujairah Creative City than in most zones, because so many licence holders are individual creatives rather than companies.

Can a Fujairah Creative City media company get the 0% free zone rate?

Rarely, for the typical creative business. The 0% rate is for a Qualifying Free Zone Person (QFZP), which is a company or branch in the zone, not an individual permit holder, and it applies only to qualifying income. Our QFZP guide sets out every condition.

Mainland-style activities, free zone tax rules

Owners often choose Creative City because the permitted activities feel close to a mainland licence. For tax, serving mainland clients has a price: that income counts toward the de minimis limit of the lower of AED 5M or 5% of revenue, and breaching it means 9% for that period and the next 4.

Small Business Relief suits many creative companies better

A resident company with revenue up to AED 3M can elect Small Business Relief for tax periods ending on or before 31 December 2029 under Ministerial Decision 131 (August 2026). It cannot be combined with QFZP. For an agency billing mainland brands, it usually beats a QFZP claim that would fail; see our Small Business Relief guide.

Does a Fujairah Creative City company need an audit, and is ESR still required?

An audit is required for Corporate Tax only if the company claims QFZP status or its revenue exceeds AED 50,000,000, under Ministerial Decision No. 84 of 2025. Whether Fujairah Creative City asks for audited or other financial statements at licence renewal is the authority’s own rule, so confirm it with Creative City before renewal.

Economic Substance Regulations are no longer filed

ESR notifications and reports ended for financial years starting on or after 1 January 2023, under Cabinet Decision 98 of 2024. If someone offers to file a current-year ESR form for a fee, you do not need it. Substance still matters in one place: a company claiming QFZP must show adequate substance in the zone.

How does VAT apply to Fujairah Creative City freelancers and agencies?

Creative services are taxed at 5% when supplied in the UAE, and designated zone rules do not help because they cover goods only. Whether Fujairah Creative City appears on the FTA’s designated zone list should be checked against the current list, but for a service business the answer rarely changes the VAT bill.

Foreign clients still count toward the threshold

Services exported to clients outside the GCC can be zero-rated when the conditions are met, but zero-rated sales are still taxable supplies. Mainland brand work is standard-rated

Fees from UAE brands and agencies carry 5% VAT once you are registered, with a tax invoice issued within 14 days of the supply. Registering late costs AED 10,000 plus the VAT you should have charged, which you may not be able to recover from past clients.

Renewing your permit does not report to the FTA

Fujairah Creative City renews permits and licences; it does not register you for VAT or file Corporate Tax. A current permit is no evidence that your FTA obligations are met.

Creative businesses have few assets and no stock, so the work is mainly in clean income records and the owner’s expenses.

6 tax mistakes Fujairah Creative City licence holders make

  • Thinking a free zone permit is tax free. Companies must file every year, and missing the return costs AED 500 a month.
  • Leaving overseas clients out of the VAT threshold. Zero-rated exports still count, so registration is late and triggers AED 10,000 plus backdated VAT.
  • Paying for an ESR filing. ESR ended for years starting on or after 1 January 2023, while the real obligations, Corporate Tax and VAT, go unfiled.
  • Claiming 0% on mainland retainers. Income from mainland clients is generally non-qualifying; a failed QFZP claim means 9% for five periods.
  • Running company income through a personal account. Without clear records the company risks the AED 10,000 records penalty and a return it cannot support.
  • Cancelling the permit and forgetting the FTA. Registrations stay open until you deregister, and late deregistration costs AED 1,000 a month up to AED 10,000.

What simple routine keeps a Fujairah Creative City business penalty free?

  • Monthly: invoice every job and log where the client is based
  • Monthly: total the last 12 months of sales, including foreign clients, against AED 375,000
  • Monthly: keep business and personal spending in separate accounts
  • Quarterly: file VAT 201 by the 28th once registered, even with no sales
  • Each January: if you are a freelancer, check whether last year’s turnover passed AED 1M

  3. Fix errors in filed VAT returns by voluntary disclosure. Before an FTA audit notice the penalty is 1% a month of the tax difference; after one it becomes 15% plus 1% a month.

Should a Creative City freelancer or agency file alone or use an accountant?

A solo creative with a handful of invoices can often manage; an agency with mainland retainers, contractors and VAT usually cannot do it safely alone.

What Fujairah Creative City freelancers and owners ask us

I have a Fujairah Creative City freelance permit, do digital marketing mostly for clients outside the UAE and earn AED 40,000 to 50,000 a month. I registered for Corporate Tax and got a TRN but have filed nothing. What should I do?

Your turnover is AED 480,000 to 600,000 a year, below the AED 1M that brings a natural person into Corporate Tax, so check in EmaraTax what your registration says is due and ask the FTA whether it should stay open. VAT is the bigger issue: that turnover is above AED 375,000, and zero-rated foreign client work still counts, so VAT registration is likely overdue. See VAT for freelancers.

A Creative City licence allows almost the same activities as a mainland licence. If I serve mainland clients, how is that taxed?

Income from mainland customers and individuals is generally non-qualifying for the 0% free zone rate, and it must stay within the lower of AED 5M or 5% of revenue for a QFZP. Above that, the company is taxed at 0% up to AED 375,000 and 9% above. Services to UAE clients also carry 5% VAT once you are registered.

How do I file ESR for my Creative City company? Agents are quoting AED 1,500 just to submit a form.

You do not need to. Economic Substance Regulations filings ended for financial years starting on or after 1 January 2023 under Cabinet Decision 98 of 2024. The obligations that apply today are Corporate Tax registration and an annual return, VAT once you pass the threshold, and substance only if you claim QFZP status.

We set up a Fujairah Creative City company but cannot open a business bank account yet. Can we start operating?

The company must register for Corporate Tax whether or not it has a bank account. If income passes through other accounts meanwhile, record every receipt and payment as company business so the books show it clearly, because records must be kept for 7 years and missing Corporate Tax records cost AED 10,000.
