VAT for Pharmacies in UAE: Zero-Rated Medicines, Standard-Rated Products and Filing

A pharmacy sells 0% and 5% items in the same basket, bills insurers and patients for one prescription, and often ends up in a refund position. This is how to set the POS, file the VAT 201 and stay clear of penalties.

UAE pharmacies charge 0% VAT on medicines and medical equipment that appear on the official zero-rated list, and 5% on everything else they sell, including cosmetics, supplements and most baby products. Each product needs its own VAT code on the POS. Registration is mandatory above AED 375,000 of taxable sales, zero-rated sales included, and the VAT 201 is due by the 28th after each period.

Does a pharmacy need to register for VAT in the UAE?

Almost every pharmacy does, because zero-rated medicine sales still count as taxable supplies for the AED 375,000 mandatory threshold. A pharmacy that sells mostly 0% prescriptions cannot stay outside VAT on the argument that it collects little tax.

Which medicines are zero-rated for VAT in the UAE?

Medicines and medical equipment are zero-rated only when they appear on the official list issued under the VAT law, not simply because a pharmacist sells them. The list is item specific, so the question is always about the exact product, not the category on your shelf label.

How to check an item before you set its rate

  • Match the product’s registered name and form against the current official list, not a supplier’s catalogue note.
  • Keep a copy of the list version you relied on with the date you checked it.
  • Recheck when a new product line arrives, when a brand changes formulation, or when the list is updated.
  • Where a product is borderline, such as a medical device sold for home use, get the treatment confirmed before selling it at 0%.

Zero-rated is not exempt

Are cosmetics, vitamins and baby products taxed at 5% in a pharmacy?

Yes, unless a specific item is on the zero-rated list, products such as skincare, sunscreen, hair care, supplements, vitamins, baby toiletries and fragrance carry 5% VAT in a pharmacy exactly as they would in a supermarket. Being sold by a licensed pharmacist does not change the rate.

Mapping every SKU to the right VAT code

The POS item master is where pharmacy VAT is won or lost. Set a VAT code per SKU, not per department, and lock the field so counter staff cannot override it. When a supplier adds a new barcode, the item should be blocked from sale until someone assigns its rate.

Run a monthly report of all 0% items sold and scan it for anything that looks like retail stock. Ten minutes on that report catches most errors before they reach the return.

Insurance co-pays on one prescription

When an insurer pays most of a prescription and the patient pays a co-pay, the VAT rate follows the item, not the payer. A zero-rated medicine is 0% on both the insurer claim and the co-pay; a 5% item approved on a claim carries 5% across both portions. Rejected claim lines that you later collect from the patient need the invoice and the claim record adjusted, so the sale is counted once.

How does a pharmacy file its VAT return?

You file the VAT 201 online through EmaraTax, after splitting the quarter’s sales into standard-rated and zero-rated totals and matching insurer claims to the POS. The steps below are the order we use for pharmacy clients.

Which documents should a pharmacy keep for VAT?

A pharmacy should keep sales, purchase and rate evidence for at least 5 years, and be able to show why each 0% item was treated as zero-rated.

  • Insurer claim submissions, remittance advices and rejection reports

What VAT dates does a pharmacy owner need to track?

The date that matters most is the 28th of the month after each tax period, when both the return and payment are due. Your quarter-ends are set by the FTA and shown in EmaraTax.

What VAT penalties can a pharmacy face in 2026?

The penalty schedule is Cabinet Decision 129/2025, in force since 14 April 2026, and for pharmacies the incorrect return penalty is the one most often triggered, usually by POS rate errors.

How it stacks: if a branch sold AED 180,000 of skincare at 0% in one quarter, the missing VAT is AED 9,000. Disclosed three months after the due date, that is AED 270 at 1% a month, and the FTA can also apply the AED 500 incorrect return penalty. Found in an audit instead, the 15% fixed charge alone is AED 1,350 before the monthly 1%.

7 VAT mistakes pharmacies make

Most pharmacy VAT errors start in the item master or at the insurance desk, and each of these produces either a wrong return or a missing document.

  • One VAT rate for every product on the POS. Setting everything to 0% under-declares VAT on retail products; setting everything to 5% overcharges patients on listed medicines and misreports both boxes.
  • Treating OTC medicines as automatically zero-rated. Only listed items are 0%, so an unlisted cough syrup or supplement sold at 0% creates a tax difference.
  • Letting counter staff override the VAT code. Manual overrides leave no trail and are hard to defend in an FTA audit.
  • Recording insurer payments on receipt instead of at dispensing. Sales end up in the wrong quarter and the return no longer ties to the POS.
  • Refunds and returns with no credit note. Each missing credit note can cost AED 2,500.
  • Not claiming input VAT because sales are mostly 0%. Zero-rated pharmacies keep full recovery; skipping it simply loses money.
  • Assuming a refund position means nothing to check. Refund claims are reviewed, so wrong 0% coding surfaces exactly when you ask for money back.

How does a pharmacy stay VAT compliant every quarter?

A pharmacy stays compliant by controlling the item master, reconciling insurers monthly and reviewing the return before the 28th. This routine works for single outlets and chains.

  • Monthly: review the 0% sales report for retail products coded wrongly
  • Monthly: approve VAT codes for every new SKU before it goes on sale
  • Monthly: reconcile insurer claims, rejections and co-pays to the POS
  • Monthly: issue credit notes for every patient refund or product return
  • Quarterly: tie POS sales, the ledger and bank receipts to the VAT 201
  • Quarterly: file and pay by the 28th
  • Every list update: recheck zero-rated items against the new version

Submit the overdue return and pay what is due today, since late payment is charged every month until the balance is cleared. Then fix the underlying rate errors and, if needed, challenge the penalty.

  • File and pay the outstanding VAT 201. Use the best POS figures you have now and correct detail later.

One wrong default on the POS turned a AED 1,500 payment into a AED 7,500 refund claim, which is exactly the kind of return the FTA looks at closely.

Is it cheaper for a pharmacy to file VAT in-house or outsource it?

For a single pharmacy with a clean POS, in-house filing is possible; once you run insurer claims across branches, outsourcing usually costs less than one incorrect return and the time spent fixing it.

Questions pharmacy owners ask us about VAT

Is exempt the same as zero-rated for our medicines?

No. Listed medicines and medical equipment are zero-rated, which means 0% VAT with full input VAT recovery. Exempt supplies, such as residential rent after the first 3 years, bare land and local passenger transport, carry no VAT but block recovery of the related input VAT.

How do we work out the VAT inside a shelf price?

For a 5% item priced VAT-inclusive, the VAT is the price times 5/105, so an AED 105 moisturiser contains AED 5 of VAT. A listed medicine at 0% contains none, which is why each item needs its own VAT code rather than one rate for the basket. Our VAT calculator does the split.

Our input VAT is higher than our output VAT. Can we get a refund?

Yes, when recoverable input VAT exceeds output VAT the return shows a refundable amount, which you can request from the FTA or carry forward. Pharmacies with mostly zero-rated sales often land here. Our guide to the VAT refund process covers the request.

Yes. The VAT 201 is filed on EmaraTax, due by the 28th of the month after the period. A late return costs AED 1,000 the first time and AED 2,000 for a repeat within 24 months.

Is there VAT on medicine in the UAE?+

Do pharmacies in Dubai charge VAT on vitamins?+

Usually yes. Vitamins and supplements are 5% unless the specific product is on the zero-rated list. The fact that a pharmacist sells them, or that they are health related, does not make them zero-rated.

How often does a pharmacy file a VAT return in the UAE?+

Does a pharmacy need to give a tax invoice for every sale?+

Can a pharmacy chain register each branch separately for VAT?+

Not if the branches belong to one legal entity: that entity has one TRN and files one return, reporting sales by emirate. Separate companies register individually unless they apply to form a VAT group.

What is the penalty for charging the wrong VAT rate on medicines?+
